These Terms & Conditions ("Terms") govern your use of https://ellan.in (the "Website") and every order placed on it. The Website is owned and operated by Ellan Style, trading as Éllan ("Éllan", "we", "us", "our"). By browsing the Website or placing an order, you ("you", "customer") agree to these Terms, our Privacy Policy, Shipping Policy and Return, Refund & Cancellation Policy, which together form the entire agreement between you and Éllan.

1. Eligibility

You must be at least 18 years of age — or use the Website under the supervision of a parent or legal guardian — to place an order. By ordering, you confirm that the information you provide is true, accurate and complete.

2. Products, Éditions & availability

• Éllan products are released in limited, numbered Éditions in small runs and are not restocked. Availability of any piece or size is not guaranteed.
• We describe and photograph every piece with care. Actual colours may vary slightly due to screen settings and photography lighting.
• Graphic placement, stitch detailing and finish may show minor variation from piece to piece; this reflects how the pieces are produced in small runs and is not a defect. Genuine manufacturing defects are always covered under our Return, Refund & Cancellation Policy.
• Product pages state material, care and sizing information; the size charts show garment measurements, not body measurements.

3. Pricing & taxes

• All prices on the Website are in Indian Rupees (INR ₹) and are inclusive of applicable GST unless stated otherwise. We sell to customers in India only.
• Shipping within India is free; any charge that ever applies to a specific order (for example a COD fee, where offered) is shown clearly at checkout before payment.
• A tax invoice is issued for every order.
• Despite our care, a price or listing may occasionally be published in error. In such cases we may cancel the affected order and will refund any amount paid in full.

4. Orders & acceptance

• Your order is an offer to purchase. It is accepted when we dispatch the item and send you a dispatch confirmation; an order-confirmation email alone is an acknowledgement, not acceptance.
• We may refuse or cancel an order in cases of suspected fraud or payment abuse, pricing or listing error, stock unavailability, or incomplete/unverifiable delivery details. If we cancel, any amount you paid is refunded in full — we never charge you for a cancellation we make.
• For cash-on-delivery orders (where offered), we may verify the order by phone, SMS or WhatsApp before dispatch; unverified orders may be cancelled.

5. Payments

• Payments are processed by secure third-party payment partners (UPI, cards, netbanking and wallets; cash on delivery where offered). All online payment processing is PCI-DSS compliant.
• We do not collect or store your card number, CVV, UPI PIN or banking credentials. Saved cards are tokenised by the payment network in line with RBI requirements.
• If an amount is debited but your order is not confirmed, the failed transaction is reversed by the payment partner within the timelines prescribed by the RBI. Write to us if a reversal does not reach you.

6. Shipping & delivery

• We ship within India only, free of charge, with tracking. Timelines and full terms are in the Shipping Policy.
• If we are unable to dispatch your order within the stated timeline for reasons other than force majeure, you may cancel it for a full refund.
• Risk in the products passes to you on delivery. Please provide an accurate address and reachable phone number; failed deliveries caused by incorrect details may delay or void redelivery.

7. Cancellations, returns & refunds

• You may cancel an order free of charge at any time before dispatch — we do not impose cancellation charges.
• Éditions are sold on a final-sale basis for change of mind: within 7 days of delivery you may exchange for another size or take store credit; no cash refunds are given for change of mind.
• Products that arrive damaged, defective, incorrect or materially different from their description are eligible for a replacement or a full refund — your choice — as required under the Consumer Protection Act, 2019.
• Full conditions, timelines and processes are in the Return, Refund & Cancellation Policy, which forms part of these Terms. Nothing in these Terms limits your statutory rights.

8. Intellectual property

• All artwork on Éllan garments is original and created for Éllan. All content on the Website — artwork, product designs, photographs, films, text, layout, the Éllan name and the Éllan script mark — is the exclusive property of Éllan and is protected under Indian copyright and trademark law.
• No content may be copied, reproduced, distributed, scraped, used to train machine-learning systems, or used commercially without our prior written consent.
• Purchasing a garment gives you ownership of that garment, not any licence to reproduce its artwork.

9. User content

If you share content featuring Éllan products (for example by tagging @ellan.in), you confirm the content is yours and grant us permission to feature it on our channels with credit. Ask us at any time to take a repost down and we will.

10. Acceptable use

You agree not to misuse the Website — including attempting unauthorised access, interfering with its operation, placing fraudulent orders, misusing offers or store credits, or using the Website for any unlawful purpose. We may restrict or terminate access for misuse.

11. Disclaimers

The Website is provided on an "as is" and "as available" basis to the extent permitted by law. We do not warrant that the Website will be uninterrupted or error-free. Product care is your responsibility after delivery — follow the care instructions on the product page; damage caused by not following them is not a defect.

12. Limitation of liability

To the fullest extent permitted by law, Éllan's total aggregate liability arising out of or in connection with any order or your use of the Website shall not exceed the amount you paid for the order concerned. We are not liable for indirect, incidental or consequential losses. Nothing in these Terms excludes or limits rights available to you under the Consumer Protection Act, 2019, or any other law that cannot be contractually excluded.

13. Indemnity

You agree to indemnify and hold Éllan harmless from claims, damages and expenses arising from your breach of these Terms or misuse of the Website.

14. Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control — including natural disasters, epidemics, strikes, courier or network disruptions, and acts of government. Statutory refund rights for undelivered orders remain unaffected.

15. Privacy

Your personal data is handled as described in our Privacy Policy, in line with the Digital Personal Data Protection Act, 2023.

16. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force.

17. No waiver

Our not enforcing any provision of these Terms is not a waiver of our right to enforce it later.

18. Assignment

You may not assign your rights under these Terms. We may assign ours in connection with a reorganisation or transfer of the business, with your protections preserved.

19. Communications

By ordering, you consent to receive transactional communications (order, payment, delivery and service updates) by email, SMS or WhatsApp. Marketing communications are sent only with your opt-in and can be stopped at any time.

20. Grievance officer

In accordance with the Consumer Protection (E-Commerce) Rules, 2020, our grievance officer's name and contact details are published on the Contact Us page. Complaints are acknowledged within 48 hours and resolved within one month of receipt.

21. Governing law & jurisdiction (India)

These Terms, and every order placed on the Website, are governed by and construed in accordance with the laws of India. Subject to your rights under applicable consumer protection law (including your right to approach the consumer commissions), the courts at Chandrapur, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Website.

22. Changes to these Terms

We may update these Terms from time to time. The version published at the time you place an order is the version that applies to that order.
